I have been trying to explain to people for a while that if you actually read the law, or have a brain, SB 1070 is a good thing.
This is a perfect example of the mindset of people who are against it and want to boycott places like hotels in Arizona (which actually have lots of illegal workers…so are actually hurting them!)
I am fortunate to have a unique perspective on this law and Az. Not only did I go to school there and learn in geography that Arizona is in fact a border state-
But I also use to train law enforcement while I lived there. My brother is a cop, firefighter AND a lawyer in Az. Phoenix is number 1 in the US for kidnappings, and number 2 in the WORLD. Only Mexico City beats them (WATCH).
Please READ- (from HB 2162 which amended SB1070)
B. For any lawful STOP, DETENTION OR ARREST made by a law
43 enforcement official or a law enforcement agency of this state or a law
44 enforcement official or a law enforcement agency of a county, city, town or
45 other political subdivision of this state IN THE ENFORCEMENT OF ANY OTHER LAW
– 4 –
1 OR ORDINANCE OF A COUNTY, CITY OR TOWN OR THIS STATE where reasonable
2 suspicion exists that the person is an alien AND is unlawfully present in
3 the United States, a reasonable attempt shall be made, when practicable, to
4 determine the immigration status of the person, except if the determination
5 may hinder or obstruct an investigation. Any person who is arrested shall
6 have the person’s immigration status determined before the person is
7 released. The person’s immigration status shall be verified with the federal
8 government pursuant to 8 United States code section 1373(c). A law
9 enforcement official or agency of this state or a county, city, town or other
10 political subdivision of this state may not consider race, color or
11 national origin in implementing the requirements of this subsection except to
12 the extent permitted by the United States or Arizona Constitution. A person
13 is presumed to not be an alien who is unlawfully present in the United States
14 if the person provides to the law enforcement officer or agency any of the
16 1. A valid Arizona driver license.
17 2. A valid Arizona nonoperating identification license.
18 3. A valid tribal enrollment card or other form of tribal
20 4. If the entity requires proof of legal presence in the United States
21 before issuance, any valid United States federal, state or local government
22 issued identification.
23 C. If an alien who is unlawfully present in the United States is
24 convicted of a violation of state or local law, on discharge from
25 imprisonment or on the assessment of any monetary obligation that is imposed,
26 the United States immigration and customs enforcement or the United States
27 customs and border protection shall be immediately notified.
If I get legally stopped by the cops and I have to show ID, why would an illegal not have to?
The cops are not just going to be driving around looking for anyone who looks hispanic (that is actually hard to do at night…see what shade of skin or even if it is a guy or girl in the car in front of you try it) there are SO many illegals that they don’t have to! They can just stop people for shit like speeding, or hitting other cars and be busy ALL DAY! Which is what the law says.
Anyone here LEGALLY gets an INS card that they are told to carry around with them at all times, you show it and you are fine. There is also a funny thing many people have in their wallet right now, a divers license that also works.
Before they just let illegals go, now they call the FEDs on them…and the problem with ANY of this is where exactly….?
